Terms and Conditions

Welcome to Fluid Dynamics! These Terms and Conditions (“Terms”) govern your use of our website, fluid-dynamics.biz, and your purchase of our products and services. By accessing our website or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our website, products or services.

1. General Information

Fluid Dynamics provides water treatment systems and solutions including equipment supply, installation assistance, programming, and operational optimization. These Terms apply to all product sales, service work, and warranty transactions unless a separate written contract has been executed between Fluid Dynamics and the customer.

2. Product Information and Availability

We strive to provide accurate product descriptions, specifications, pricing, and availability; however, errors may occur. We reserve the right to correct inaccuracies and to discontinue or modify any product or service without notice. Photos, diagrams, and descriptions are provided for reference only and may differ from the actual products delivered.

3. Orders, Payment, and Pricing

By submitting an order, you represent that all billing and shipping information is accurate and complete. All prices are listed in U.S. dollars and exclude applicable taxes, shipping, and installation unless otherwise stated in writing.

Fluid Dynamics reserves the right to refuse or cancel any order for any reason, including suspected fraud or pricing errors. Payment terms must be honored as invoiced. Unpaid balances may incur interest, collection fees, or suspension of further orders.

4. Shipping and Delivery

Delivery times vary by product type, location, and carrier performance. Risk of loss transfers to the customer once the order is delivered to the shipping carrier. Fluid Dynamics is not liable for delays caused by manufacturer backorders, freight damage, or carrier issues.

Customers must inspect shipments immediately upon receipt and report any shortages or damages within five (5) business days.

5. Returns, Refunds, and Exchanges

All sales are final. No returns, refunds, or exchanges are accepted unless expressly authorized in writing by Fluid Dynamics. Any authorized return must include a Return Material Authorization (RMA) and may be subject to a restocking fee.

Unauthorized returns will not be accepted or credited.

6. Warranty and Liability

6.1 Product Warranties

Most products supplied by Fluid Dynamics include a warranty provided by the original manufacturer. The terms, duration, and conditions of those warranties are determined solely by the manufacturer. Such warranties generally cover defects in material or workmanship only and exclude damage from misuse, improper installation, or conditions beyond specification.

Material compatibility and system application are the responsibility of the customer unless a full analysis was submitted and approved in advance. Products purchased through Fluid Dynamics but manufactured by others are subject only to the applicable manufacturer’s warranty.

6.2 Fluid Dynamics Limited Workmanship Warranty

Fluid Dynamics warrants that any components assembled, configured, or installed by Fluid Dynamics personnel will be free from defects in workmanship for ninety (90) days from the date of installation, unless otherwise stated in writing.

This limited warranty does not extend to system performance issues caused by third-party products, design modifications, or site conditions outside Fluid Dynamic’s control.

6.3 Warranty Claims Process

To initiate a warranty claim:

  • Notify Fluid Dynamics in writing within ten (10) business days of discovering the issue.
  • Provide proof of purchase, installation date, serial numbers, failure date, and a detailed description of the defect.
  • Do not remove, disassemble, or return any product without written authorization and a valid Return Material Authorization (RMA).
  • Fluid Dynamics will review the claim, coordinate evaluation, and advise whether the issue qualifies for warranty coverage or is considered billable.

Failure to follow this process may void warranty consideration.

6.4 Warranty Coverage and Exclusions

Warranty coverage applies only to defects arising from normal, intended use. Coverage does not include:

  • Normal wear items such as seals, bearings, filters, or nozzles.
  • Damage caused by freezing, cavitation, corrosion, electrical irregularities, chemical spill, or system contamination.
  • Costs for removal, reinstallation, freight, or travel unless expressly authorized in writing.
  • Service labor not pre-approved by Fluid Dynamics.
  • Any product disassembled prior to evaluation.

Products exposed to hazardous or contaminated materials must be properly cleaned and accompanied by appropriate safety documentation before return.

6.5 Remedy and Limitation of Liability

The customer’s exclusive remedy for defective products is limited to repair or replacement, at Fluid Dynamic’s discretion or that of the warranting party. Transportation and handling costs to and from the service location are the responsibility of the customer unless the defect is confirmed to be warranty-covered.

Fluid Dynamics is not liable for consequential, incidental, or indirect damages—including downtime, loss of profits, or loss of business—arising from product failure or service delays. In all cases, Fluid Dynamic’s maximum liability shall not exceed the original purchase price of the affected product or service.

7. Service Work and Site Support

All service work, diagnostics, and technical support are billed at current rates unless covered by a separate written agreement. Labor, travel time, and materials used during service calls are chargeable unless explicitly approved as warranty work. Customers are responsible for providing safe, unobstructed access to all equipment during service.

8. User Conduct and Website Use

By accessing or using our website, you agree not to:

  • Use the site for unlawful or fraudulent activities.
  • Transmit malware, spam, or attempt to breach security features.
  • Copy, reuse, or distribute content without written authorization.

9. Intellectual Property

All website content, logos, and materials are the property of Fluid Dynamics and protected by applicable intellectual property laws. Unauthorized use or reproduction is prohibited.

10. SMS/Text Messaging Terms

Fluid Dynamics offers customers and website visitors (“you”) the option to receive text messages (SMS/MMS) via our webchat and related communication channels, including appointment reminders, order and service updates, account notifications, and promotional or marketing messages (“Program”).

10.1 Consent and Opt-In

By submitting your mobile phone number through our webchat widget, a web form, or another designated opt-in method, and checking the applicable consent box or otherwise affirmatively agreeing, you consent to receive recurring text messages from Fluid Dynamics at the mobile number provided, including messages sent using an automatic telephone dialing system or similar technology. Consent to receive text messages is not a condition of purchasing any goods or services.

10.2 Message Frequency and Fees

Message frequency varies based on your interactions with us and the types of messages you opt into (e.g., service alerts, order updates, promotions). Message and data rates may apply. Contact your wireless carrier for details about your text and data plan.

10.3 How to Opt Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a one-time confirmation message and you will receive no further messages from that Program until you opt in again. You may also contact us directly at the email or phone number listed on fluid-dynamics.biz to request removal.

10.4 Help

For help at any time, reply HELP to any message you receive from us, or contact us at the email or phone number listed on fluid-dynamics.biz.

10.5 Supported Carriers

Our text messaging Program is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless provider and factors outside our control.

10.6 Privacy and Use of Mobile Information

We will not share your mobile opt-in status or mobile phone number with third parties or affiliates for their own marketing or promotional purposes. Your information will be used in accordance with our Privacy Policy (see Section 11), which describes how we collect, use, and protect your data.

10.7 Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, and the owner or authorized user of the mobile device used to opt in, to participate in this Program.

10.8 Changes to the Program

We reserve the right to change or cancel this text messaging Program, or any portion of it, at any time without notice, including the right to change any telephone number or short code we use to operate the Program.

11. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to learn how we collect, use, and protect your information, including information collected through our text messaging Program described in Section 10.

12. Governing Law

These Terms and any disputes arising from your use of our website or purchase of products or services shall be governed by the laws of the State of Kansas, USA. Venue shall be in the courts of Johnson County, Kansas.

13. Updates to Terms

Fluid Dynamics reserves the right to update or modify these Terms at any time without prior notice. Updates will be posted on this page and become effective immediately upon posting. Continued use of the website or services constitutes acceptance of any revised Terms.
